Topmonhit Story '08 Holiday Special: Season Stalkings is the 2008 Topmonhit Story Christmas special. It involves an insane toad believing that Santa Claus is stalking him (due to him supposedly always watching you), and therefore he sues him.

Story
Part 1
In an empty room save for a toad with rainbow spots and a radio, a toad was listening to said radio, which was playing Santa Claus is Coming to Town. Immeidately the toad jumped up and began to sing instead Santa Claus is Stalking You Down. Once that was over, it cut to Top's House, where there was a peaceful snow out. Top was excited about it almost being Holiday, and Topper was flipping through television channels when he went past "to be suing Santa". Oshy told him to go back, and they watched as News Guy and Toadette reported on a toad claiming that Santa Claus was stalking him, and was sueing Santa over these charges.
Toadette said they had gotten an interview with the toad, who yelled that Santa was stalking him. Toadette asked why he thinks this, and he said that Santa is constantly watching everyone, stalking them for his own evil purposes. When asked about the people who think he's crazy, the toad answered that they had all bought into the Christmas business and that Santa was truly evil. News Guy reported that an angry mob had just formed outside the studio. When News Guy, Toadette and the crazy toad came out, the mob threw candy canes at the toad.
Just then everyone heard sleigh bells in the sky, and saw as a sleigh pulled by winged white Yoshis flew overheard. News Guy spoke of it as amazing, but the crazy toad yelled that Santa was also mean to yoshis (which resulted in another candy cane hitting him). The sleigh landed, and out came Santa. The crazy toad tried to attack him, but some security guards held him back. Santa asked what all the business about being him being sued was, and the News Guy explained. Santa thought the notion was silly, but the crazy toad yelled that he was planning to turn everyone into mindless elves or something. News Guy reported that they would have coverage of the proceeding trial.
Meanwhile, at the Warioware Office Building, Wario and Waluigi were watching this news. Wario was surprised to see Santa actually existed, mostly because he never got anything from him. Waluigi was sarcastic, but Wario figured if Santa thought he was good enough to skip Wario, he had another thing coming, and they went to get the Warioware Jet... except there wasn't one. At Top's House, Oshy said this was nearly as bad as a crazy turtle trying to steal Christmas. Topper suggested to Top that he should make a call, and though Top was confused at first, Topper said Santa would need a lawyer. Meanwhile, at Not There, someone recieved a call from Top about the situation. Deciding to help, Top's Lawyer hung up and prepared to get his lawyer face on.

- This is the only Topmonhit Story Holiday Special of 2008.
- This is Top's Lawyer's first appearance in Topmonhit Story.
- Team TOT mention It's Freakin' a Freakin' YB Freakin' Holiday!, as they had first met Santa in that story.
- This is the first Holiday special Topmonhit was involved in where Kienstrom did not appear (save for a cameo that was made to make note that Kienstrom was not in the special).
