<br>(4) Those who are part of an enterprise that operates a public service or has obtained a concession from the government, or those who are attorneys, representatives, or advisers of such an enterprise;

<br>(6) Those whose citizenship rights are suspended.

<u>Article.</u> Deputies and senators shall receive a monthly remuneration, which shall be established in the General Budget of Revenues and Expenditures of the Republic. The monthly remuneration to the deputies and senators may not be renounced, withheld, or attached.

<u>Article.</u> The armed forces may not enter the premises of either chamber or of the Congress in joint session except at the request of the presiding officer, and they shall remain at his orders.

<u>Article.</u> The sessions of the chambers and of Congress in joint session shall be public, except in those cases in which it is otherwise established by this Constitution or the respective regulations.

<u>Article.</u> No regular deputy or senator, or alternate holding office, from the time of his election or installation, may be appointed or elected to public office or employment paid from national, departmental, or municipal government funds, and the appointment shall have no legal effect unless he first resigns as a representative. The following positions are excepted from the incompatibility stipulated in this article: positions on international arbitration tribunals, in the field of teaching, on the boards of directors of the universities, and those on the social welfare boards.

They may also be members of technical or scientific commissions, hospital directors or physicians, lawyers or counselors of any state institution or agency of the executive branch.

<u>Article.</u> A deputy or senator who absents himself from the country for more than thirty days without permission of the chamber to which he belongs, or in the recess thereof, of its president, shall cease to hold his office. Special laws alone can authorize an absence of more than a year.

<u>Article.</u> For the purposes of voting in the chambers of Congress, a simple majority shall be understood to mean one half of the legal quorum plus one; an absolute majority, at least the legal quorum; a two-thirds majority, two-thirds of the legal quorum; and a two-thirds absolute majority, two thirds of the total number of members of each chamber. The legal quorum shall consist of one half of that total, plus one, in each case. When the type of majority is not specified, it shall be understood to be a simple majority.

<u>Article.</u> Each chamber shall elect its officers, issue its regulations, and appoint its staff.

<u>Article.</u> Congress in separate session has the following powers:
 
-
 
-
(1) To enact laws; to interpret, amend, and repeal existing laws;

<br>(2) To establish tribunals and regulate the administration of justice and of contentious-administrative matters;
 
-
<br>(3) To examine infractions of the Constitution and do what is necessary in order to make effective the responsibility of those who infringe it;
 
-
<br>(4) To establish the political division of the territory of the Republic and the municipal organizations;
 
-
<br>(5) To enact and order the publication of the Civil, Commercial, Criminal, Labor, and Social Security Codes;
 
-
<br>(6) To enact the electoral law;

<br>(7) To declare and specify the duration of a state of economic emergency whenever abnormal circumstances of the country so demand. Such a declaration of emergency shall suspend, if so ordered, any or all guarantees set forth in Article _____. The laws enacted on the basis of this declaration may not be in force to the detriment of stated constitutional guarantees longer than the time fixed by the corresponding decree;

<br>(8) To take cognizance of the decree-laws issued by the executive branch in the event of emergency or public necessity;

<br>(9) To levy the necessary taxes to meet budgetary expenditures, provide for their distribution, collection and appropriation, and to repeal, modify, or increase those in existence;

<br>(10) To authorize the executive branch to negotiate loans pledging the national treasury and indicating funds for their amortization;
 
-
<br>(11) To regulate trade with foreign nations;
 
-
<br>(12) To recognize the national debt and indicate the means for its consolidation and amortization;
 
-
<br>(13) To establish mints, fix the content, weight, type and the denomination of the currency, to determine the value of foreign currencies, and to adopt a general system of weights and measures;
 
-
<br>(14) To create or abolish public employments, to determine or to modify their attributes, to increase or diminish their salaries, to grant pensions and to decree public honors to those rendering distinguished services. Laws granting pensions must be passed by a vote of two-thirds of the members present in each chamber;

<br>(15) To specify the functions of government employees and indicate the territorial jurisdictions in which they are to be exercised;
 
-
<br>(16) To authorize the executive power to declare war and conclude peace;
 
-
<br>(17) To authorize, for specific periods of time, on the proposal of the executive power, concessions for the establishment of new industries or national public services, as well as for the extraction and transformation of raw materials;
 
-
<br>(18) To enact laws for the organization of the _____ Diplomatic Corps and Consular Corps;
 
-
<br>(19) To establish, organize, and maintain throughout the Republic rural, elementary, superior, secondary, and professional schools, and schools for scientific research, of fine arts, and of technical training; practical schools of agriculture and mining, of arts and crafts, museums, libraries, observatories, and other institutions concerning the general culture of the inhabitants of the Nation, and to legislate on all matters relating to such institutions; and to legislate on matters concerning archeological, artistic, and historic monuments, the conservation of which is of national interest;

<br>(20) To enact laws pursuant to which captures on sea and land must be declared good or bad; and to enact maritime laws applicable in peace and war;
 
-
<br>(21) To raise and maintain the armed forces of the Republic, to wit: Army, Navy and Air Force, and to regulate their organization and service;
 
-
<br>(22) To prescribe regulations for the purpose of organizing, arming, disciplining, and training the National Police;
 
-
<br>(23) To determine in each ordinary legislative session, and in extraordinary sessions when required, the effectives of the armed forces;
 
-
<br>(24) On the proposal of the executive power, to issue military ordinances and enact the organic law of the military courts;
 
-
<br>(25) To enact laws concerning general means of communication, and in regard to posts and post offices;
 
-
<br>(26) To grant subsidies or premiums for objects of public utility that are intended to establish new industries or stimulate agriculture or stock-raising;
 
-
<br>(27) To enact laws in regard to nationality, the legal status of foreigners, citizenship, naturalization, emigration and immigration;
 
-
<br>(28) To establish the legal rules governing the transfer and lease of fiscal and municipal assets;
 
-
<br>(29) To establish rules for the occupation and alienation of vacant lands and fix their price;
 
-
<br>(30) To safeguard the proper exploitation and conservation of natural resources and preservation of the environment;
 
-
<br>(31) To regulate river and air navigation;
 
-
<br>(32) To register ships and aircraft as _____ in accordance with the law;
 
-
<br>(33) To approve the general guidelines for the national economic and social development plan to be submitted by the executive power during the third quarter of the first year of each constitutional term;

<br>(34) To provide everything relevant to human development, economic progress with social justice, the growth of the national economy, the creation of jobs, the general public health, and the defense of the currency value;
 
-
<br>(35) To enact the organic law governing the Tribunal of Accounts;
 
-
<br>(36) To grant general amnesties for political offenses and common offenses related thereto. In no case may pardons include civil liabilities toward private individuals;
 
-
<br>(37) To legalize the extraordinary or supplementary credits authorized by the President of the Republic in Council of Ministers;
 
-
<br>(38) To fix the monthly remuneration that deputies and senators shall receive. The remuneration cannot be changed during a legislative period except to take effect in the period following;
 
-
<br>(39) To enact internal resolutions and decisions, and to formulate declarations in conformity with its powers;
 
-
<br>(40) To enact all laws that may be necessary to enforce the foregoing powers, and all others granted by this Constitution to Congress.
 
-
 
-
<u>Article.</u> The powers of the legislative branch may not be delegated, except those of legislating in the fields of public works, police, social welfare, public health, defense, public education, agriculture, labor, finances and economy, industry, and commerce, which may be delegated to the executive power to be exercised during the adjournment of Congress. The power delegated to legislate on finances does not include that of levying taxes or contributions or that of changing items in the General Budget of Revenues and Expenditures of the Republic. However, the President of the Republic, in Council of Ministers, may establish general taxes or contributions whenever a civil war or international war in which the republic is engaged breaks out, or a catastrophe justifying such measures occurs, the matter being reported to Congress at its next meeting.

<center>Chapter II<br><u>Chamber of Deputies</u></center>

-
<u>Article.</u> The Chamber of Deputies shall consist of seventy deputies elected, with their respective alternates, directly by the people, under a system of proportional representation which takes into account the votes cast in favor of each party throughout the country.
 
-
 
-
Each department shall have at least two deputies.
 
-
 
-
The number of deputies may be changed by law, the enactment of which shall require a two-thirds vote of the full membership of each chamber.
 
-
 
-
<u>Article.</u> The Chamber of Deputies shall be renewed in the aggregate every three years.

-
<u>Article.</u> The qualifications for being elected deputy are the following:
 
-
 
-
(1) To be a _____ citizen by birth;

<br>(2) To have attained twenty-five years of age at the time of the election;

<br>(3) To be a native of the department in which the election is held, or a resident thereof with effective residence for more than six months prior to its date. Residence is not lost by absence in the discharge of elective public office; and

<u>Article.</u> The exclusive powers of the Chamber of Deputies are:

(1) To approve the General Budget of Revenues and Expenditures of the Republic, after first discussing the taxes which, in its judgment, must be levied to cover it;

<br>(2) To initiate the consideration of bills relating to the tax, monetary, and banking systems, and to the contracting of loans;
 
-
<br>(3) To initiate the consideration of any bill relating to electoral or municipal legislation;
 
-
<br>(4) To supervise, through a committee drawn from its body, the correct performance of the functions of the Tribunal of Accounts;
 
-
<br>(5) To vote resolutions of censure against the President of the Council of Ministers and the Ministers. A censure motion shall be debated only two days after being submitted to the Chamber of Deputies, which shall have the power to decide by an absolute majority of the full membership of the Chamber that the censure shall include the removal from office of the President of the Council or the Minister concerned;

<br>(6) To examine accusations presented by its own members or by private individuals against the President of the Republic, deputies, senators, magistrates of the courts of justice, Ministers of State, diplomatic agents, and the president of the Tribunal of Accounts; and if the charge appears well founded, to submit the corresponding impeachment to the Senate;

<br>(7) To exercise any other powers which this Constitution expressly confers upon it.

-
<center>Chapter III<br><u>Senate</u></center>
 
-
 
-
<u>Article.</u> The Senate shall consist of thirty regular senators and their respective alternates, elected directly by the people, in a single national election district.
 
-
 
-
The senators shall be elected by the system of integral proportional representation.
 
-
 
-
<u>Article.</u> The Senate shall be renewed every three years by parts in the manner determined by law. Each senator shall remain nine years in office.

-
<u>Article.</u> The qualifications for being elected senator are the following:

-
(1) To be a _____ citizen by birth;

<br>(2) To have attained forty years of age at the time of the election; and

<u>Article.</u> The exclusive powers of the Senate are:

(1) To approve or reject the treaties, conventions, concordats, and other international agreements made by the President of the Republic with foreign powers;

<br>(2) To initiate the consideration of bills relating to national defense, to expropriations, and to the limitation of real property ownership;
 
-
<br>(3) To consent to the appointment of the attorney general and the ambassadors and ministers plenipotentiary of the foreign service of the Republic, as well as to military promotions beginning with and including the rank of colonel in the Army, or its equivalent in the other branches of the armed forces and in the services;
 
-
<br>(4) To authorize the departure of national troops beyond the borders of the country, the passage of foreign troops through the national territory, and the sojourn of squadrons of other powers for more than one month in _____ waters;
 
-
<br>(5) To try impeachments submitted by the Chamber of Deputies against the officials referred to in Article _____ by a hearing of the accused. If the latter does not appear he shall be tried in absentia;
 
-
<br>(6) To grant or deny its consent to the acts of the President of the Republic in cases in which the Constitution or the law so requires. If the Senate does not pass upon the matter within thirty days after call for urgency by the President of the Republic, its consent shall be taken for granted;
 
-
<br>(7) To exercise any other powers which this Constitution may assign to it.
 
-
 
-
<u>Article.</u> When the Senate tries the officials impeached by the deputies, the following rules shall be observed:
 
-
 
-
(1) If the impeachment refers to offenses committed while holding office, and the Senate acting as a jury finds the party guilty, it shall impose as the penalty removal from office, when appropriate, and disqualification from holding public office for the time specified by law, without prejudice to a criminal trial of the guilty party before the Supreme Court of Justice if his acts show liability deserving other punishment;

<br>(2) If the impeachment refers to other offenses, the Senate shall limit itself to a statement of whether or not there are grounds for prosecution, and if its finding is affirmative, it shall pass the case on to the Supreme Court of Justice and place the accused at its disposition. If the Senate declares that there are no grounds for prosecution, the official shall be restored to office.

<center>Chapter IV<br><u>Congress in Joint Session</u></center>
 
-
 
-
<u>Article.</u> Congress in joint session shall be presided over alternately by the presidents of the two chambers, for periods of three months each.
 
-
 
-
<u>Article.</u> Congress in joint session has the following powers:
 
-
 
-
(1) To elect its own board of officers, which shall consist of a president, a vice president, and two secretaries, with corresponding vice secretaries;
 
-
<br>(2) To regulate the order of business of its meetings and all matters concerning its internal organization;
 
-
<br>(3) To declare the President of the Republic elected, in accordance with the electoral law, and to receive his constitutional oath of office;
 
-
<br>(4) To declare vacant the Presidency of the Republic in the cases which the Constitution indicates;
 
-
<br>(5) To accept or reject the resignation of the President of the Republic, of the magistrates of the courts of justice, and of the president of the Tribunal of Accounts;
 
-
<br>(6) To elect, by a two-thirds vote, the magistrates of the courts of justice, with their respective alternates, in accordance with Article _____, as well as the president of the Tribunal of Accounts;
 
-
<br>(7) To receive the constitutional oath from the officers it elects or to delegate this power;
 
-
<br>(8) To take cognizance of the report presented by the executive branch on measures taken during the suspension of constitutional guarantees;
 
-
<br>(9) To grant honorary citizenship to foreigners who have rendered eminent services to the Republic;
 
-
<br>(10) To grant to illustrious _____ who have rendered eminent services to the Republic, the honors of the National Pantheon, when twenty-five years have elapsed since their death;
 
-
<br>(11) To establish, by a three-fourths vote, the national coat of arms, the flag of the Republic, and the national anthem;
 
-
<br>(12) To exercise such other functions and powers that this Constitution and the laws may give it.

-
<center>Chapter V<br><u>Enactment and Sanction of Laws</u></center>
 
-
 
-
<u>Article.</u> Acts approved by the chambers as co-legislative bodies are termed laws. Laws which systematically cover rules relating to a given subject may be termed codes.
 
-
 
-
<u>Article.</u> Organic laws are those which are so designated by this Constitution and those which are invested with this character by an absolute majority of each chamber when the respective bill is introduced therein.
 
-
 
-
Laws which are enacted on matters governed by organic laws are subject to the rules contained in the latter.
 
-
 
-
<u>Article.</u> The introduction of bills pertains to the President of the Republic and to the deputies and senators of Congress.
 
-
 
-
The bills submitted by the President of the Republic shall be referred at once to committee. Those which are introduced by deputies or senators shall be subject to the procedure prescribed in the regulations on debate.
 
-
 
-
<u>Article.</u> All bills shall be presented with a statement of reasons for them.
 
-
 
-
<u>Article.</u> Every bill or proposed decree, the resolution of which does not pertain exclusively to one of the chambers, shall be discussed successively in both, the regulations on debate being observed as to form, intervals of time, and mode of procedure in discussions and voting.
 
-
 
-
<u>Article.</u> A bill approved in the chamber of its origin shall be referred to the other for discussion. If the latter approves it, it shall be sent to the President of the Republic who, if he has no objections to make, shall immediately publish it.

-
<u>Article.</u> Every bill shall be regarded as approved by the executive branch if it is not returned to the chamber of its origin within ten business days; unless, during this time, the Congress shall have adjourned or suspended its sessions, in which case the return must be made on the first business day on which the Congress next meets.

<u>Article.</u> A bill rejected in whole or in part by the President of the Republic shall be returned, with his objections, to the chamber of origin. It must be discussed anew by the latter, and if it is confirmed by a vote of two thirds of the total membership it shall again be sent to the revisory chamber. If it is sanctioned by the latter by the same majority, the bill shall become a law and shall be returned to the President of the Republic for promulgation.

<u>Article.</u> If any bill is rejected in its entirety by the chamber of revision, it shall be returned to that of its origin with the objections made by the former. If upon examining it anew, it is approved by an absolute majority of the members present, it shall be returned to the chamber that rejected it, which shall again consider it and if it approves it by the same majority, it shall be sent to the President of the Republic for the purposes of Article _____; but if disapproved, it cannot be again introduced in the same period of sessions.

<u>Article.</u> If a bill is rejected in part, or amended or added to by the revisory chamber, the new discussion in the chamber of origin shall be confined to the part rejected or to the amendments or additions, without alteration in any way of the articles approved. If the additions or amendments made by the revisory chamber are approved by an absolute majority of votes present in the chamber of origin, the entire bill is sent to the President of the Republic for the purposes indicated in Article _____. If the additions or amendments made by the revisory chamber are disapproved by a majority of the votes in the chamber of origin, they shall be returned to the former for consideration of the reasons of the latter, and if the amendments or additions are rejected in this second revision by an absolute majority of votes present, the bill, insofar as it has been approved by both chambers, shall be sent to the Executive for the purposes indicated in Article _____. If the revisory chamber insists, by an absolute majority of votes present, upon such amendments or additions, the entire bill shall not be again presented until the following period of sessions unless both chambers agree, by an absolute majority of their members present, that the law be issued only with the approved articles, and those added or amended shall be reserved for examination and vote at the following sessions.

<u>Article.</u> In the interpretation, amendment, or repeal of laws, the same procedure shall be followed as that established for their enactment.

<u>Article.</u> Every bill which is rejected in the chamber of its origin, cannot be again introduced in the sessions of that year.

<u>Article.</u> Bills may be introduced in either chamber, except those which by a special provision of this Constitution must necessarily be introduced either in the Chamber of Deputies or the Senate.

<u>Article.</u> Bills shall preferentially be discussed in the chamber in which they are introduced, unless one month elapses since they were sent to the reporting committee without a report being made, in which case the bill may be discussed in the other chamber.

<u>Article.</u> Regardless of their stage of passage, the President of the Republic may withdraw any bills that he has sent from Congress and table them or postpone their presentation until another legislative session.

<u>Article.</u> The President of the Republic cannot offer objections to the resolutions of the Congress or of either chamber, when they exercise functions of an electoral body or of a jury, nor when the Chamber of Deputies declares that a high functionary of the Republic should be impeached for official crimes.

Neither may he do so in regard to a decree of convocation to extraordinary sessions issued by the Delegated Committee.

<u>Article.</u> The phrase to be used in the sanction of laws shall be the following: "The national Congress of the Republic of _____ sanctions with the force of Law." <u>Article.</u> Prior to adjourning, each chamber shall each year appoint, by an absolute majority, the fifteen deputies and ten senators who shall together constitute the Delegated Committee of Congress, which shall act until the following session. The Committee shall elect its officers, and shall give written notice thereof to the other powers of the State. It may conduct a valid session with the presence of a simple majority of its members. In matters put to a vote, in case of a tie, the chairman shall decide.

If on the date established the Congress not succeed in forming a quorum in order to meet, the ceremony shall be held immediately before the Supreme Court of Justice.

<u>Article.</u> A citizen who has held the office of President of the Republic, by popular election or by appointment as ad interim, provisional, or substitute President, can in no case and for no reason again hold that office. This prohibition may not be modified or repealed. The author or authors of a proposal for modification or repeal, and those who support it, directly or indirectly, shall cease <u>ipso facto</u> in the occupation of their respective posts and shall be permanently incapacitated for the exercise of any public office.

<u>Article.</u> The official office of the President of the Republic shall be in the Government House, and the National Treasury shall defray the expense of a residence for him that is in keeping with the dignity of his office. He shall be entitled to a salary, which may not be changed during his term of office, and during that term he may not engage in any other employment, nor devote himself to his profession, business or industry, nor receive any other emolument from the Republic.

<br>(8) To receive chiefs of diplomatic missions of foreign countries and admit their consuls and to appoint ambassadors and ministers plenipotentiary of the foreign service of the Republic, with the approval of the Senate, or during its recess, of the Delegated Committee of Congress;

<br>(9) To negotiate and sign treaties of peace, friendship, commerce, navigation, alliance, boundaries, and neutrality, and concordats and other international agreements, and to ratify them after approval by the Senate;

<br>(10) To decree the severance of relations, and in accordance with a prior resolution of Congress, to declare war, provided that arbitration or other pacific means to avoid it have been unsuccessful;

<br>(11) To grant letters of marque, in accordance with rules enacted by Congress;

<br>(12) To grant, in conformity with the law, severance and retirement pensions and annuities;
+

<br>(13) To commute sentences and grant private pardons, upon the report of the Supreme Court of Justice and in accordance with the law. Officials impeached by the Chamber of Deputies and tried by the Senate can be pardoned by Congress only. The President of the Republic may not exercise this power with respect to the Ministers of State;

<br>(14) To grant awards and extend temporary privileges permitted by the Constitution to authors and inventors of works of general utility and to persons who have introduced new industries or improved existing ones;
+

<br>(15) To sign contracts, in accordance with the Constitution and the laws, for the rendering of services and the execution of public works and for the general interest;
+
-
<br>(16) To secure and protect the property of artists and writers and of the inventor or discoverer, in accordance with the law;
+
-
<br>(17) To indicate, during adjournment of Congress, the place to which the organs of government shall be temporarily transferred, whenever there are serious reasons for this step;

<br>(18) To open and close ports and to establish, transfer, or close down maritime and frontier custom houses, and designate their location;
+

<br>(19) To grant, for outstanding merit, the decorations, medals, diplomas and prizes that are established by law;

<br>(20) To exercise the other functions of government and administration assigned to him under this Constitution.

<u>Article.</u> Whenever in his opinion the public tranquility is threatened, the President of the Republic may order the detention of persons presumed responsible, interrogate them, and hold them in custody for ten days, within which time they must be freed or turned over to a competent court; but if in the opinion of the chief of state it is necessary to confine such persons, he may, in Council of Ministers, order their confinement.
